Thinking about creating an estate plan? Or wondering if you even need one? At The Lawyers O’Reilly PC, our Albuquerque estate planning attorney Brendan O’Reilly can help you set your affairs in order no matter how big or small your estate.
Why, estate planning is for everyone! Well, almost everyone. Anyone who owns assets can likely benefit from having an estate plan in place.
Oh, but we addressed those questions out of order, didn’t we? So, what exactly is estate planning?
An “estate” refers to an individual’s assets—their house, property, bank account, life insurance, vehicle, business, savings, investments, personal possessions, and all that jazz. Whether extravagant or modest, an estate is still an estate.
An “estate plan” then is exactly that. It details a plan for what should be done with your estate in the event you suffer a debilitating injury, severe illness, or death. It allows you the peace of mind of knowing your belongings and loved ones will be taken care of if—and when—something happens to you. Estate plans can also save your family the immense stress and conflict that can come with trying to divvy up your assets themselves after your passing.
Even though people tend to associate estate planning with wealth, retirement, and aging, it really is for everyone. We highly recommend at least consulting with an attorney about whether an estate plan is right for you before dismissing the idea completely. Fortunately, we offer free consultations!
No two estate plans will look exactly the same. Each individual has their own values, familial roles, and varying amounts of wealth and possessions. The Lawyers O’Reilly PC will work closely with you to determine the estate plan that best fits you and your wishes.

This is our service mark and we proudly state it on the wall in the lobby of our office. However, it often causes clients and potential clients to stop and ask: "Am I an ‘exceptional’ client?" The answer is "Yes! You are!" This statement is not one about the size of your estate, but rather our goals for the quality of the documents that will help express your wishes with respect to decision-making during your lifetime (if you become incapacitated) and after your death. You are an exceptional estate planning client not based on the size of your estate, but based on your desire to create a quality estate plan.
We assist clients ranging from moderate estates needing basic estate plans, to very large estates requiring complex estate planning often with estate tax and Generation Skipping Transfer tax planning. We do not handle contested matters, and also do not litigate, but we otherwise look forward to creating an exceptional estate plan with you.
The same is true for our service mark “Providing exceptional intellectual property services for exceptional clients™". We assist clients with inventions of all complexity levels, as well as businesses with a single trademark of concern or an entire portfolio of products and/or service lines. We believe that every individual or business with an entrepreneurial bent is exceptional, as each presents a unique situation requiring thoughtful planning and careful execution.
Wilcox & Myers, P.C. is also “Providing exceptional business law services for exceptional clients™". This applies both to our estate planning clients and our intellectual property clients (which also often overlap). Properly structuring and maintaining a corporation or limited liability company can not only help a business be successful, but can help protect client assets and prevent legal problems down the road as well.

Those of us who call the Land of Enchantment home are highly entrepreneurial and often have small businesses or unusual assets. We have strong family ties. Our firm is deeply rooted in this state and we are attuned to the unique needs of the people here.
Our approach is one of respect and caring. Death can be quite devastating to families. The depth of our experience enables us to prepare our clients for this eventuality and guide them to outcomes that make financial sense, as well as sense for their family.
To me, there’s no greater honor than someone selecting me to assist them through the legal process associated with a death. I’ve sat down with hundreds of people over the years. I’ve seen a wide variety of situations, but I will not ever tell you I know how you feel because it’s different for everybody.
The loss of a loved one is never easy, but we strive to make it less overwhelming by making the legal ramifications as straightforward as possible.
As a small firm, we have the opportunity to get to know our clients and their families personally. In some cases, we have worked with three generations of the same family over an extended period of time. Our collaborative process ensures that our clients have the information and guidance they need to proceed confidently with their estate planning decisions.
I believe that being a lawyer is about serving. All of us at this firm chose the estate-planning field because we see it as an opportunity to have a positive impact on people’s lives at a difficult moment of transition.
Estate planning is a bit like ranching. It’s easier to prepare and do the work up front than it is to solve problems down the line. Rather than be the ranch hand who has to gather animals all over the range after they have escaped from the coral, we prefer to keep them in the coral, and keep things orderly.
We do everything we can to prepare our clients so the difficult decisions are made in advance and the plans for the disposition of the estate are up to date.
This proactive approach fosters clear thinking and leads to decisions that make the most sense for your family and your finances. We believe that while tax efficiency is an important part of estate planning, the most important component is the effect on the family. We help our clients make informed choices well in advance so that a plan is in place for any eventuality.

Probate and trust litigation is often highly complicated and requires deep-rooted knowledge in this area of law. NM Trust and Probate Law Firm, LLC in Albuquerque represents executors, spouses, family members and beneficiaries throughout the state in disputes over estates. We have extensive knowledge and familiarity with the Uniform Probate Code and Uniform Trust Code, which we draw on when representing your position in probate or trust litigation. Whether you are fighting against the terms of a trust or will or defending yourself from malicious or grieving family members, we will tenaciously protect your legal rights while offering the compassionate counsel you deserve.
This firm represents clients involved in a range of probate and trust disputes, including:
Breach of fiduciary duty claims — In New Mexico, executors under a will, trustees who administer trusts, and agents under a power of attorney owe the principal a fiduciary duty to act in his or her best interest. We can represent beneficiaries and family members if the trust or estate has not been properly managed.
Lack of capacity claims — If your loved one did not understand the nature of the document he or she was signing, such as a will, trust or power of attorney, we can fight to get the document invalidated. We will press to honor your rights pursuant to a previous document that was executed in a lawful manner.
Undue influence claims — Aging can often be a difficult and emotional process. Sometimes, scammers or others will ingratiate themselves into the life of an elderly person to try to gain advantage. In other situations, a person close to your loved one might have threatened to withhold care or love if a change to an estate plan was not made. Claims of undue influence arise when a departed person is influenced by another person to change or alter his or her estate unnaturally. Usually the departed person is in a vulnerable and/or weakened state when this happens and the influencer is in a position of confidence and authority over the departed person. Claims arise when that influence is used to change the departed person’s testamentary wishes in a way that benefits the influencer.
